Terms of Service

These Terms of Service ("Terms") govern your use of the WinVision website (winvision.app), the WinVision desktop application, and the WinVision AR client (collectively, the "Services"), provided by Axipert LLC ("we," "us," or "our"). By using any of the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. The Services

WinVision is a free screen sharing application that captures your desktop screen, encodes it, and streams it to AR glasses and web browsers over your local network using WebRTC.

  • Desktop Application: Software you download and run on Windows, macOS, or Linux to capture and stream your screen.
  • AR Client: A companion application for AR glasses that receives and displays the streamed content.
  • Website: The winvision.app site where you can download the software, learn about features, and report issues.

2. License and Usage

We grant you a free, non-exclusive, non-transferable, revocable license to use the WinVision applications for personal and commercial purposes, subject to these Terms.

  • WinVision is free to use. You do not need to pay to download or run the applications.
  • The software is proprietary. You may not reverse-engineer, decompile, disassemble, or create derivative works based on the applications, except where required by applicable law.
  • You may not redistribute, sublicense, or sell the applications or any part of them without our written permission.

3. Acceptable Use

You agree not to use the Services to:

  • Stream content that you do not have the right to share (copyrighted material, confidential information belonging to others, etc.).
  • Capture or share someone else's screen without their knowledge and consent.
  • Distribute malware, spam, or any harmful content through the bug report form or any other feature.
  • Attempt to overload, disrupt, or gain unauthorized access to our website or services.
  • Circumvent rate limits, CAPTCHA protections, or other security measures.
  • Use the Services in any way that violates applicable laws or regulations.

4. Bug Reports and Submissions

When you submit a bug report through our website, it is posted as a public issue on our GitHub repository. By submitting a report, you acknowledge that:

  • Your submission (including any attached log files and email address) will be publicly visible.
  • You should not include sensitive personal information, passwords, or confidential data in your submissions.
  • We may use your submission to improve WinVision, and you grant us a perpetual, worldwide, royalty-free license to use the content of your report for that purpose.

5. Intellectual Property

All rights, title, and interest in the WinVision applications, website, branding, and related materials are owned by Axipert LLC. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

6. Third-Party Services

The Services integrate with third-party services including GitHub, Microsoft Clarity, Cloudflare Turnstile, Google Fonts, and jsDelivr. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

7. No Warranty

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Specifically:

  • We do not guarantee any particular level of streaming quality, latency, or compatibility with your hardware.
  • Hardware-accelerated encoding depends on your system's GPU and drivers, which are outside our control.
  • WebRTC connectivity depends on your local network configuration.

8. Limitation of Liability

To the maximum extent permitted by law, Axipert LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Services — even if we have been advised of the possibility of such damages.

Because the Services are provided free of charge, our total liability to you for any claim arising from these Terms or the Services shall not exceed $50 USD.

9. Indemnification

You agree to indemnify and hold harmless Axipert LLC from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the Services, your violation of these Terms, or your violation of any third party's rights.

10. Termination

We may suspend or terminate your access to the Services at any time, for any reason, without notice. You may stop using the Services at any time by uninstalling the applications and ceasing to visit the website. Sections 5, 7, 8, 9, and 12 survive termination.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved in the state or federal courts located in Delaware.
